A DESPERATE DUTTON  RESORTS TO LIES, SLANDER AND FALSE ALLEGTIONS AFTER THE LOSS OF THE CROWN COURT CASE AND APPEAL (Please go to the news and links  page on this web site, and scroll underneath the links for further info!!!)

 APRIL 2008 DUTTON FOUND UNANIMOUSLY  GUILTY IN CRIMINAL CROWN COURT PROSECUTION! 

FEBRUARY 2009, DUTTON LOSES HIS APPEAL IN THE LONDON LAW COURTS!

JUNE 2009 AMPHIJEEP LTD STRUCK OFF AND COMPANY  DISSOLVED AHEAD OF COMPENSATION PAYMENT!!! THATS NINE COMPANIES TIM DUTTON HAS HAD DISSOLVED SINCE 1994 AND FOURTEEN IN TOTAL.

In 2005 I invested in Dutton and his product, but at the time had no idea of his chequered trading history.  I do not want others to suffer what we have been through, so if you are considering investing in his vehicles or products we urge you to read on so you can make  a calculated decision as to whether or not it is worth the risk!

A WARNING TO OTHERS!

As a potential customer of Tim Duttons Amphijeep ask yourself :

Why has Tim Dutton had yet another company, Amphijeep ltd, struck off and Dissolved?  The Ninth company he has had dissolved in a very short space of time!

I WOULD LIKE TO POLITELY ASK YOU TO TAKE TIME TO READ THIS ARTICLE AND ITS SUMMING UP:

In 2005 I commissioned Tim Dutton the company director of the then “Amphibious cars limited” to build an 8 seat amphibious car for a proposed “Amphibious tour business” taking in the mountain roads and waters of “Lake Windermere”

I was so convinced of its success I put into the business my life savings, and a small inheritance from my late mother. I also secured a 17 thousand pound business start up bank loan “plus interest” to secure the future of the business. As a non mechanic with no experience of engineering I placed complete trust in the expertise of “Timothy Dutton” to guide me into the specification of a craft best suited for the job.

Instead, the vehicle I received was five months late and in an extremely dangerous and unusable condition. Through naivety, and insistence by Tim Dutton, I had already paid for the vehicle on delivery, and before I realised the true extent of the problems with it. Because of the unexplained delays on the promised delivery of the vehicle, I had already missed a full Season trading and was beginning to get into financial difficulties, so was therefore desperate to begin trading with it. However on subsequent inspections by marine surveyors and mechanical engineers it was deemed so dangerous that Trading standards launched a criminal prosecution against Tim Dutton personally. A prosecution that was successful with Dutton being found unanimously guilty in record time at Crown court. He also lost his appeal within the London law courts in early February.

Apart from placing the lives of myself and paying passengers in extreme danger, I also lost my home and business. I have yet to receive a penny in compensation while he trades as normally yet claims he is  penniless. The Financial and mental stress caused by this whole affair has been devastating for both myself and my family, particularly when we ended up having to live in a homeless hostel with our eleven year old son. We have now been re-housed by the council but are still struggling to recover financially.

THE STATEMENT OF OFFENCE:

Consenting to or conniving at the commission of a trade descriptions offence, contrary to section 1(1) b and Section 20 of the Trade Descriptions Act 1968.

PARTICULARS OF OFFENCE:

Timothy Dutton Woolley, on or about the 9th day of December 2005, being the managing Director of Amphibious Cars limited, consented to and/or connived at the commission of an offence committed by Amphibious Cars limited, in that the said company, in the course of a trade or business, did supply Lake-Lander Limited a Dutton S2 Commander amphibious vehicle to which false trade descriptions was applied, namely that the vehicle was fit for the purpose of carrying passengers on land and water, and /or that the offence was attributable to his neglect.

It was only after Tim Dutton lost the court case and subsequently his appeal in February 2009 that he decided for one reason or another to come clean about his trading history on his website, and name some of the many companies he has headed as a director.

Tim Dutton has now had yet another company Dissolved and Struck off as recently as June 2009 “Amphijeep limited” a company incorporated after our complaint was first upheld in the civil courts. We strongly believe that the reason for Amphijeep ltd being dissolved is because the compensation was due to us in August 2009.

I lost my business and my home because of the cost of my mistakes in dealing with Mr Dutton. It is a very bitter pill to swallow when you are left in a homeless hostel with your partner and eleven year old son, and the man responsible, found Unanimously guilty in crown court by a jury in record time is taking cheap pot shots at you on his web site. This included naming his new vehicle after the company I have lost (Lake-Lander).

Although Amphijeep Ltd ceased trading in December 2008 Tim dutton was still making reference to it as a limited company on his history Page as recently as January 2010, we felt this was also very misleading to customers so a complaint was lodged with Worthing Trading standards.  He has now been made to amend this page.

On the same page in January 2010 he was still making reference to the court case involving "Amphibious Cars Ltd" as being "ongoing", even though in reality he lost his appeal in February 2009.  The reason  he gave for the winding up of this company was that he was "Advised" to cease trading because of the ongoing court case.  We felt this gave a complelely false reason as to why the company was really wound up shortly after our case first went to court.  The reason he gave to the official receiver was that "there was no interest in Amphibious cars".  Worthing Trading Standards have again asked him to amend this, but now on his "Brief History of Tim Page" he makes no reference whatsoever to "Amphibious Cars limited" or its existence, an important piece of history you would think.

Under investigation it has been shown that for many of his companies he simply does not send in his completed accounts, meaning that Companies House move to strike that company off after a given period of time. Companies that have folded often owing people many thousands of pounds. He then incorporates a new company.

This was the case with Amphibious cars Limited. My Solicitor at the time “Heyton Winkley” caught wind of what was going on, and lodged an objection against Amphibious Cars ltd being wound up, but unfortunately a few months later and before our civil action was concluded, HM Customs and Excise moved again to close the business with companies house, as I was informed they were also owed money.

He has now had a total of Nine Companies dissolved since April 1994

Tim Dutton was described in crown court by the

Right Honourable Judge Batty during his summing up as “dishonest and glib.

It was proved in court beyond reasonable doubt that had I been allowed to take this vehicle around the mountain roads and waters of lake Windermere with passengers on board, including families with young children, it would have resulted in disastrous consequences. Tim Dutton knew the exact purpose for this vehicle and personally chose to place second hand parts on it and remove other parts off it, whilst those he did fit, particularly in relation to the safety of those on board, were ill fitting and wholly unsafe. Something for which he has shown no remorse for or made any apologies for.

He has sought by his own comments to discredit every professional person who stood up in court and gave evidence against him, and there were many, including Marine Surveyors and mechanical engineers and inspectors with many years experience. Yet in the same breathe he claims on his web site that, “if any servicing /repair work is required any competent garage can undertake it,”

Had it not been for Trading standards bringing the Criminal court case against Dutton, myself and my partner would have been in a hopeless position, unable to afford the costs of a court case against an apparently “successful business man” whom somehow, although claiming record amphibious car sales on his web site, and having customers with, and I quote in his own words used in Crown Court, “more money than they know what to do with.” has been able to take full advantage of the British legal aid system, throughout both the Civil and Crown court cases. Something that during the civil action Myself and Katie were unable to do because of our position as a Limited Company

SUMMARY

My advise would be that when dealing with Tim Dutton and before you part with any of your hard earned cash, make sure that the vehicle you are getting is the same vehicle that was passed through the Single Vehicle Approval Test! and not a dangerously modified version of the so called finished product, something by way of a legal loophole he is still allowed to do. The vehicle we received had been changed virtually beyond recognition, and had he presented it for the Single Vehicle Approval Test in the condition it was delivered to us, V.O.S.A have stated categorically it would have failed.

It is also a sobering thought that the Craft we received under re-inspection by recognised and highly qualified Boat Safety Scheme inspectors failed on both the Commercial and Non Commercial boat safety testing protocol. Yet it was delivered to us with a “Boat Safety Scheme certificate”.

 As well as Trading standards myself and Katie are incredibly grateful to everyone involved in the case including: Marine surveyors, British Boat Safety scheme Inspectors and Assessors, the Vehicle Operator Service Agency, The National Park Authority Lakes Wardens and Rangers, Fire service and the Police. They were the people that instead of holding inquiries after a disaster happened, saw fit to prevent it happening in the first place.
